By downloading, installing, or using one of the "Text With" mobile/web/desktop apps (the "App", which includes "Text With Jesus", "Text With History"), you are agreeing to be bound by these Terms and Conditions (the "Agreement"). If you do not agree to the terms of this Agreement, do not download, install, or use the App. This Agreement is a legal agreement between you and Catloaf Software LLC, a California limited liability company ("Catloaf Software", "we", "us", or "our").
Subject to the terms of this Agreement, Catloaf Software grants you a limited, non-exclusive, non-transferable license to download, install, and use the App, including its Progressive Web App version, on devices that you own or control and as permitted by the Usage Rules set forth in the Apple App Store, Google Play Store, and Microsoft Store Terms of Service.
The App, including all copyrights, trademarks, trade secrets, patents, and other intellectual property rights are, and shall remain, the sole and exclusive property of Catloaf Software. You agree not to reverse engineer, decompile, disassemble, modify, or create derivative works based on the App.
Catloaf Software respects your privacy and is committed to protecting it. By using the App, you agree to our Privacy Policy which governs the collection, use, and disclosure of your information.
The App offers a premium subscription that provides access to additional AI personas and features. Subscriptions are billed on a monthly or annual basis, depending on your selection. Payment for the subscription will be processed through your Apple, Google or Stripe account, depending on your selection, at the time of purchase confirmation. The subscription fee is charged up front at the beginning of each billing period. This could be monthly or annually, depending on your selection. The subscription is set to automatically renew unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings after purchase. You may also opt to purchase a lifetime subscription as a non-recurring in-app purchase. Payment will be charged as a single transaction to your account at the confirmation of purchase.
The App is provided "as is" and "as available" without any representations or warranties, express or implied. Catloaf Software disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
In no event shall Catloaf Software be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or related to this Agreement, the App, or your use thereof.
This Agreement is governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association.
Catloaf Software reserves the right to modify this Agreement at any time by posting the revised terms on our website or within the App. Your continued use of the App after such changes constitutes your acceptance of the new terms.
